The said lawmaker punched a waiter at Biggs Diner in Legazpi City, Albay on July 7.
The suspect was identified as Probinsyano party-list Representative Alfred Delos Santos. The victim, Christian Kent Alejo, was 20.
A closed circuit television (CCTV) footage showed Delos Santos standing up from his seat to punch the waiter with his left hand.
The lawmaker was with three companions when the incident occurred.
A police blotter on the incident identified the waiter as Christian Kent Alejo, 20 years old.
The reason is not yet clear why the congressman did it.
